Agreement to Terms

By accessing and using our mail handling and organization services, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Description of Services

We provide professional mail handling, sorting, organization, storage, and related services. Our services include but are not limited to:

Mail collection and processing
Sorting and categorization
Secure storage and archiving
Digital scanning and archiving
Mail forwarding and delivery
Document shredding and disposal

Service Agreement

A formal service agreement will be entered into before services commence. The service agreement will specify the scope of services, pricing, payment terms, and other relevant details. These Terms of Use supplement, but do not replace, the specific terms of your service agreement.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms of Use. You agree not to:

Use our services in any way that violates any applicable laws or regulations
Use our services to transmit or store any illegal, harmful, or fraudulent content
Attempt to gain unauthorized access to our systems or networks
Interfere with or disrupt the operation of our services
Use our services to send spam or unsolicited communications
Violate the intellectual property rights of others

We reserve the right to suspend or terminate your access to our services if you violate these acceptable use provisions.

User Responsibilities

You agree to:

Pay all fees in accordance with the payment terms

Limitation of Liability

While we take every reasonable precaution to protect your mail and documents, we cannot guarantee absolute security against loss, damage, delay, theft, or destruction. We are committed to providing professional service, but certain risks are inherent in mail handling and delivery services.

To the maximum extent permitted by law, our liability for any loss, damage, delay, or destruction of mail or documents is limited to:

The replacement value of the items, as determined by you at the time of service commencement, or
The cost of the services provided in connection with the lost, damaged, or delayed items, whichever is less

We are not liable for any of the following, to the extent permitted by law:

Consequential, indirect, special, punitive, or incidental damages
Loss of profits, revenue, business opportunities, or goodwill
Loss or damage resulting from delays in delivery or processing
Loss or damage resulting from acts of nature, war, terrorism, or other events beyond our reasonable control
Loss or damage resulting from your failure to provide accurate information or instructions
Loss or damage to items that were not properly addressed, packaged, or labeled

These limitations apply regardless of the theory of liability (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

You acknowledge and agree that you are responsible for maintaining adequate insurance coverage for valuable items and that our services are not a substitute for such insurance. We strongly recommend that you obtain appropriate insurance coverage for high-value or irreplaceable items.

Intellectual Property

All content, trademarks, logos, and intellectual property on our website and in our materials are the property of Vorkalinvordalon or our licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

Payment Terms

Fees for services are as specified in your service agreement. Payment is due according to the terms set forth in the agreement. Late payments may result in service suspension or termination. All fees are in Australian Dollars unless otherwise specified.

Termination

Either party may terminate the service agreement with written notice as specified in the agreement. Upon termination, we will return your mail and documents according to your instructions. Outstanding fees remain due and payable.

Confidentiality

We maintain strict confidentiality regarding your mail and personal information. Our staff are bound by confidentiality agreements and privacy obligations as detailed in our Privacy Policy.

Dispute Resolution

Any disputes arising from these terms or our services will be resolved through good faith negotiation. If negotiation is unsuccessful, disputes will be resolved through binding arbitration in accordance with Australian arbitration laws, or through the appropriate courts of New South Wales, Australia.

Before initiating formal dispute resolution proceedings, you agree to contact us directly to attempt to resolve the dispute informally. We will make good faith efforts to resolve any disputes within 30 days of receiving notice.

Applicable Law

These Terms of Use shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms of Use will be brought exclusively in the courts of New South Wales, Australia, and you hereby consent to the personal jurisdiction of such courts.

Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Material changes will be communicated to active clients. Continued use of our services after modifications constitutes acceptance of the updated terms.
